Southern Cross Bet - General Terms & Conditions

1. General

a. Southern Cross Bet is the trading name of Southern Cross Bet Pty Ltd (hereafter Southern Cross Bet), ACN 634 669 524. Southern Cross Bet is licensed by Racing NSW and regulated by The Office of Liquor, Gaming and Racing (OLGR) to accept wagers by the telephoneand the Internet on a global basis 24 hours a day.

b. By opening a Southern Cross Bet betting account or placing a bet with Southern Cross Bet either on-line or via the telephone, you agree to be bound by the terms and conditions set out below (the 'Rules') so please read the following carefully. Additionally, by opening an account, you are deemed to have read and accepted Southern Cross Bet's Privacy Policy located at www.southerncrossbet.com.au (Website).

c. To open a wagering account with Southern Cross Bet ('Account') you must be aged 18 years or older. A 'Client' is a person who holds an Account, and any reference to 'you' or 'your' in these rules is a reference to a Client.

d. You agree that the service offered by Southern Cross Bet is the ability to place a bet with possibilities of a win or a loss.

e. Any rule is subject to change without notice and it is the responsibility of the person seeking to rely on the Rules to ensure they are making reference to the most recent Rules by visiting our website at www.southerncrossbet.com.au or by contacting via email at  [email protected]

 

2. Client Responsibility

a. You are responsible for ensuring that your records, in particular address, telephone number and payment/bank details (including any credit card expiration details), are kept up-to-date and to notify us immediately of any incorrect Account details. If you have not kept your records up to date, Southern Cross Bet reserves the right to suspend your Account.

b. You agree that by registering with Southern Cross Bet, your contact details, including your email address, mobile number and mailing address, may be used by Southern Cross Bet to keep you informed about products, promotions, services and events. Southern Cross Bet does not sell personal information to other companies.

c. There are limited circumstances in which external organisations may be given access to your personal information. One circumstance is where an Australian governing sporting body requests information of a Client and that information will only be provided to assist in a legitimate inquiry conducted by the Australian governing sporting body to maintain the integrity of the sport.

d. It is the your responsibility to ensure that you keep your User ID and password confidential. If you suspect that your details may no longer be confidential, you should notify Southern Cross Bet immediately. Providing identity can be confirmed, passwords can be changed via a telephone conversation with one of our staff. Upon notification of the new details, Southern Cross Bet reserves the right to invalidate any future transactions which utilise the previous details.

e. You will be responsible for all wagers in which your User ID and password are used for any activity on your Southern Cross Bet Account, unless you have notified Southern Cross Bet in accordance with Rule 2 (c) above. Any wager made by telephone or via the Internet where your User ID and password have been used will be regarded by Southern Cross Bet as being valid and may not be changed, cancelled or modified unless you inform Southern Cross Bet as soon as practicable after the wager was placed (but before the event has commenced) that the wager was made in error and the initial wager shall only be voided and replaced with another wager at the sole discretion of Southern Cross Bet management.

f. Where a client opens an account with Southern Cross Bet, the Client must comply with points set out in section 3 to our satisfaction to fully activate your Account and withdraw funds.

 

3. Client Identification Requirements

a. You are required to provide Southern Cross Bet with adequate identification (ID) in line with all Australian Financial Institutions under the Anti-Money Laundering and Counter-Terrorism Financing Act 2006 (Commonwealth) and the Australian Rules of Racing. ID means your name, residential address ('address') and date of birth, as provided to us upon applying for your Account

b. We have endeavoured to make the ID verification process as smooth as possible by using a third-party identity verification service.  

c. Before you deposit funds and place your first bet, you accept that your ID will be supplied to VIX Verify or another third party for the purpose of ID Verification, which may involve checking your ID against third party databases and/or credit headers. We may also require you to provide originals or certified copies where necessary   

d.  Your account can be verified by clicking on the "Verifiy Account" button in the My Account section. If required, you may be prompted to provide additional information and/or upload additional documents to complete the verification process. For example:

  • a current Australian driver licence
  • a current Australian passport, plus
  • a utitility bill (not a mobile phone bill) no more than 3 months old, with your name and 'address' (as registered with this account) clearly stated on the bill.

e. Your ID will need to be verified prior to the first withdrawal from your account, or within 14 days of you opening an Account. If your ID has not been received at this stage the Account will be suspended, no betting can take place and you will not be able to withdraw funds from your account until verification has been completed. Please note that all bets placed prior to the account being suspended will stand.

 

4. Deposits and Withdrawals

a. Clients may deposit into their account via Credit/Debit Card, Electronic Funds Transfer (EFT), POLi, cash or cheque via Bank Deposit. Southern Cross Bet reserves the right to remove or restrict payment methods for Clients who reside outside of Australia.

b. Southern Cross Bet requires that any deposit into a Client's account be turned over at least once prior to authorising a withdrawal from the Client's account.

c. Southern Cross Bet does not charge Clients fees for Credit/Debit card transactions; however, the card holder may be charged a fee by their own banking institution upon depositing funds with Southern Cross Bet which is your responsibility to pay.

d. Clients must have completed the identification process as explained in section 3, prior to any withdrawal being processed.

e. You must be the approved user/owner of any credit cards that you have linked to your Southern Cross Betting account. We may also require you to provide us with a legible copy of both sides of the card and/or request other methods proving that you are the owner of the card(s).

5. Your Conduct

a. You must not open or attempt to open an Account using another persons identity (including but not limited to using another persons name, date of birth, address, telephone number and email address). You must not access, operate or use or attempt to access, operate or use another persons account.

b. We may, in Our absolute discretion, impose any limits or conditions on any person who opens or attempts to open an Account with Us where the device or network is shared (including within a particular residential address) or otherwise unsecured.

c. You may not have more than one Account. If you have opened more than one Account, we will close additional Accounts and transfer any Account balance and any eligible pending bets to a remaining active Account. If your first Account has been closed for any reason, bets will be cancelled, voided or reversed whether they are pending or resulted. Winning funds will be forfeited and retained without any liability on Our part.

d. If You are found to have created an Account with Us while being on a break or having self-excluded then all pending bets will be voided, winning bets will be forfeited, the Account will be closed permanently and any deposits made whilst self-excluded will be returned to the customer.

e. Your Account is for your own personal use. You must not permit another person to access your Account and You must not use your account on behalf or for the benefit of another person.

f. If We believe that You have breached the Terms and Conditions, or there has been unusual activity on Your account, We may in Our absolute discretion, do one or a combination of the following:

  • Suspend or terminate Your account
  • Restrict You from withdrawing funds from Your account
  • Prevent You from accessing Your account and Our betting platforms
  • Require You to go through an account reactivation process.
  • Require you to provide any additional information that is necessary for Us to conduct an investigation and/or verify Your compliance with the terms and conditions (including a statutory declaration, identification documentation or authority to verify information with Your financial institution) even if You have provided this previously.
  • Cancel, void or reverse any bets whether they are pending or resulted. Winning funds will be forfeited and retained without any liability on Our part.

g. You will not attempt to use the Website to deliberately transfer money from one account to another by attempting to match bets on an event with another Account through collusion.

h. You will inform us as soon as You become aware of any errors in calculations with respect to any betting transaction. We reserve the right to declare null and void any bets which are the subject of such an error.

i. You will not disguise or interfere in any way with the IP address of the computer You are using to access the Website or otherise take steps to prevent Us from correctly identifying the actual IP address of the computer You are using whilst accessing the Website.

j. You agree it is Your responsibility to account for any tax or duty imposed on You as a result of any of Your betting transactions.

k. You will not make offensive comments, use offensive or pornographic material or make potentially defamatory or inflammatory remarks in connection with any part of the Website including within Your own username or in other information contributed to the Website.

l. You agree that you will not be abusive or threatening toward our staff when communicating with us by telephone, email, or any other method.

 

6. Responsible Gambling

a. Southern Cross Bet does not allow persons under the age of 18 years to hold a Southern Cross Bet account. If your children have access to the computer you use to log into the Southern Cross Bet website, we recommend the installation of a child protection software package. (E.g. Net Nanny)

b. Southern Cross Bet makes every reasonable effort to prevent self-excluded customers from returning and using our service. If you wish to self-exclude yourself, send a SIGNED email through to [email protected] or by filling out the form in the Responsible Gambling section in ''My Account' and your account will be suspended indefinitely.

c. If you are a self-excluded customer, you must not attempt to open an Account or place any bets with us. However, if you open a duplicate account whilst you are self-excluded you are fully liable for your actions and for all activity and bets placed on your account.

d. Southern Cross Bet does not market or promote to individuals younger than 18 years old, and we do not market to individuals for whom gambling has become a problem.
